An Act To Protect Charter Schools by Requiring Them To Be Operated as Nonprofit Organizations
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 20-A MRSA §2401, sub-§9, ¶¶F and G, as enacted by PL 2011, c. 414, §5, are amended to read:
F. Operates in pursuit of a specific set of educational objectives as defined in its charter contract; and
G. Operates under the oversight of the authorizer from which its charter contract is granted and in accordance with its charter contract . ; and
Sec. 2. 20-A MRSA §2401, sub-§9, ¶H is enacted to read:
H. Operates as a nonprofit organization.
Sec. 3. 20-A MRSA §2401, sub-§11, as enacted by PL 2011, c. 414, §5, is amended to read:
11. Virtual public charter school. "Virtual public charter school" means a public charter school that offers education services predominantly through an online program and operates as a nonprofit organization.
