Amend the amendment in Part D by striking out all of sections 5 and 8.

Amend the amendment in Part D in section 10 in paragraph F in the first line (page 125, line 16 in amendment) by striking out the following: " and"

Amend the amendment in Part D by striking out all of section 11 and inserting the following:

Sec. D-11. 20-A MRSA §203, sub-§1, ¶¶K to M  are enacted to read:

K Director, PK-20, Adult Education and Federal Programs Team;
L Director, Special Services Team; and
M Director, Communications.

Amend the amendment in Part D by inserting after section 12 the following:

Sec. D-13. Contingent effective date. The Maine Revised Statutes, Title 5, section 943, subsection 1, paragraph L and Title 26, section 1401-B, subsection 1, paragraph B, subparagraph (8) do not take effect until the position of Director, Bureau of Unemployment Compensation first becomes vacant following enactment of this Part. The Commissioner of Labor shall inform the Revisor of Statutes when this contingency occurs and the Revisor shall update the Maine Revised Statutes to reflect the changes.’

Amend the amendment in Part DD in section 23 in subsection 1 in the first line (page 150, line 3 in amendment) by inserting after the following: "personnel" the following: 'as of April 1, 2012'

SUMMARY

This amendment makes the following technical changes to Committee Amendment "A":

1. It removes the designation of the Public Relations Representative in the Department of Inland Fisheries and Wildlife as a major policy-influencing position and the requirement that the position be appointed by the Commissioner of Inland Fisheries and Wildlife;

2. It adds the positions of Director, PK-20, Adult Education and Federal Programs Team and Director, Special Services Team as major policy-influencing positions in the Department of Education, subject to appointment by the Commissioner of Education;

3. It provides that the change made to the position of Director, Bureau of Unemployment Compensation, making it subject to appointment by the Commissioner of Labor, does not take effect until the position becomes vacant;

4. It clarifies that the transfer of the economist positions from the State Planning Office to the Office of Policy and Management takes effect on July 1, 2012;

5. It specifies that the transition provisions transferring employees from the State Planning Office apply to employees who were in those positions as of April 1, 2012; and

6. It specifies that certain functions related to land use planning are transferred to the Department of Conservation, instead of the Department of Economic and Community Development.
