An Act To Repeal Inactive Boards and Commissions

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 4 MRSA §1701,  as amended by PL 1999, c. 547, Pt. B, §13 and affected by §80, is repealed.

Sec. 2. 5 MRSA §55,  as amended by PL 2003, c. 20, Pt. OO, §2 and affected by §4, is repealed.

Sec. 3. 5 MRSA §82-B,  as amended by PL 2009, c. 74, §§5 to 7, is repealed.

Sec. 4. 5 MRSA §285-A,  as amended by PL 2009, c. 64, §1, is repealed.

Sec. 5. 5 MRSA §7020,  as enacted by PL 2009, c. 483, §1, is repealed.

Sec. 6. 5 MRSA §12004-A, sub-§49,  as enacted by PL 2009, c. 344, Pt. A, §3 and affected by Pt. E, §2, is repealed.

Sec. 7. 5 MRSA §12004-C, sub-§6,  as enacted by PL 1993, c. 706, Pt. A, §1, is repealed.

Sec. 8. 5 MRSA §12004-F, sub-§10,  as repealed and replaced by PL 1989, c. 503, Pt. A, §10, is repealed.

Sec. 9. 5 MRSA §12004-G, sub-§4-B,  as enacted by PL 2001, c. 196, §1, is repealed.

Sec. 10. 5 MRSA §12004-G, sub-§4-D,  as enacted by PL 2009, c. 352, §1, is repealed.

Sec. 60. 25 MRSA §2954,  as repealed and replaced by PL 1993, c. 680, Pt. B, §2, is repealed.

Sec. 65. 35-A MRSA §122, sub-§1-B,  as enacted by PL 2009, c. 655, Pt. A, §2, is repealed.

Sec. 66. 35-A MRSA §1712,  as enacted by PL 2007, c. 657, §2, is repealed.

Sec. 67. 37-B MRSA §158, sub-§1,  as enacted by PL 2009, c. 481, §6, is repealed.

Sec. 68. 37-B MRSA §532,  as enacted by PL 2007, c. 318, §3, is repealed.

Sec. 69. Revisor's review; cross-references. The Revisor of Statutes shall review the Maine Revised Statutes and include in the errors and inconsistencies bill submitted to the Second Regular Session of the 125th Legislature pursuant to Title 1, section 94 any sections necessary to correct and update any cross-references in the statutes to provisions of law repealed in this Act.

SUMMARY

This bill repeals boards and commissions that have failed to file an annual report as required by the Maine Revised Statutes, Title 5, section 12005-A for 2009 and 2010 and those that have reported inactivity during 2009 and 2010.

1. The boards and commissions repealed for failing to file annual reports are:

A. Acquired Brain Injury Advisory Council;
B. Advisory Board of the Maine Learning Technology Fund;
C. Advisory Committee on School Psychological Service Providers;
D. Commission to Protect the Lives and Health of Members of the Maine National Guard;
E. Board of Trustees of the Maine School of Science and Mathematics;
F. Driver Education and Evaluation Programs Appeals Board;
G. Interagency Review Panel;
H. Interdepartmental Committee on Transition;
I. Lobster Advisory Council;
J. Maine Council of Poverty and Economic Security;
K Maine Food Policy Council;
L. Maine Fuel Board;
M. Maine Quality of Place Council;
N. Maine Vaccine Board;
O. Board of Directors of the Mixed Martial Arts Authority of Maine;
P. New England Board of Higher Education;
Q. Prison Industries Advisory Council;
R. Probate and Trust Law Advisory Commission;
S. Publicly Supported Private Secondary School Advisory Council;
T. Seed Potato Board;
U. State Employee Health Commission; and
V. We Support Our Troops Advisory Board.

2.. The boards and commissions repealed for inactivity are:

B. Advisory Committee on Fair Competition with Private Enterprise;
C. Aquaculture Advisory Council;
D. Education Commission of the States;
E. Judicial Compensation Commission;
F. Maine Biomedical Research Board;
G. Maine Drug Enforcement Agency Advisory Board;
H. Notary Public Review Board;
I. Policy Review Council;
J. Railroad Crossing Information Council;
K. Submerged Lands Advisory Board; and
L. Travel Information Advisory Council.
