Amend the bill by striking out the title and substituting the following:

‘Resolve, To Review Oversight and Advisory Responsibilities Related to Services for Adults with Intellectual Disabilities or Autism Spectrum Disorders’

Amend the bill by striking out everything after the title and inserting the following:

Sec. 1. Stakeholder group. Resolved: That the Department of Health and Human Services, referred to in this resolve as "the department," shall convene a stakeholder group, referred to in this resolve as "the stakeholder group," to conduct a review of oversight and advisory functions performed by the department or by other organizations created under state or federal law, rule, regulation or contract related to services provided or overseen by any state agency for adults eligible under the Maine Revised Statutes, Title 34-B, chapters 5 and 6. The stakeholder group must include adults receiving services pursuant to those 2 chapters and members of their families or their guardians and representatives of entities created by or under state or federal law to perform oversight or advisory functions related to services these adults receive, including representatives of the following:

1. The Disability Rights Center;

2. Speaking Up For Us of Maine;

3. The Department of Health and Human Services, Office of Advocacy;

4. The Maine Developmental Services Oversight and Advisory Board;

5. The Maine Developmental Disabilities Council;

6. The quality improvement council, an advisory board to the department's office of adults with cognitive and physical disabilities services; and

7. The Maine State Rehabilitation Council; and be it further

Sec. 2. Review. Resolved: That, in conducting the review, the stakeholder group shall:

1. Consider all oversight and advisory functions and responsibilities of existing entities that focus on services for adults eligible under the Maine Revised Statutes, Title 34-B, chapters 5 and 6; and

2. Review all functions and responsibilities required by law, the possibility of duplication and overlap of services, the possibility of unmet needs for oversight or advisory services and expenditures of state funding for services; and be it further

Sec. 3. Report. Resolved: That the department shall report to the Joint Standing Committee on Health and Human Services by December 7, 2011 with any findings and recommendations of the stakeholder group for legislation or amendments to rules.’

SUMMARY

This amendment replaces the bill, which was a concept draft, with a resolve. The amendment requires the Department of Health and Human Services to convene a stakeholder group to review oversight and advisory functions, laws and funding regarding services for adults with intellectual disabilities or autism spectrum disorders and to report to the Joint Standing Committee on Health and Human Services by December 7, 2011.
