An Act To Curb the Noise of Motorcycles without Mufflers

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §1912, sub-§7  is enacted to read:

7 Confiscation of muffler.   If a law enforcement officer stops a motorcycle for excessive or unusual noise pursuant to subsection 1 that is due to the condition of the muffler, the law enforcement officer shall confiscate the muffler.

Sec. 2. 29-A MRSA §1912, sub-§8  is enacted to read:

8 Penalty.   A person who violates subsection 1 with a motorcycle commits a traffic infraction for which a fine of not less than $150 may be adjudged.

Sec. 3. Rulemaking. The Department of Public Safety shall adopt rules to establish procedures for the retention of a registration certificate and plate when a person is stopped for operating a motorcycle without a muffler and to give the court direction pertaining to the destruction of an illegal exhaust pursuant to the Maine Revised Statutes, Title 29-A, section 1912, subsection 3. Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

This bill imposes a fine of $150 for operating a motorcycle without a muffler. The bill also requires a law enforcement officer to confiscate a muffler that is making excessive noise.
