Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 38 MRSA §1310-N, sub-§12  is enacted to read:

12 Citizen advisory committee notification.   The department may not issue a license, permit, order or approval or an amendment to a license, permit, order or approval to a state-owned solid waste disposal facility that has applied for such a license, permit, order or approval or amendment unless the commissioner finds, based on information that must be submitted by the owner or operator of the facility, that a citizen advisory committee related to that facility and established pursuant to law or resolve has been informed of the application and given the opportunity to carry out its advisory responsibilities established in section 2171 or the resolve that authorized the establishment of the committee. The owner or operator of the facility shall submit the information required under this subsection with each application.

This amendment is the minority report of the committee. The amendment prohibits the Department of Environmental Protection from issuing a license, permit, order or approval or an amendment to a license, permit, order or approval to a state-owned solid waste disposal facility unless the owner or operator of the facility submits information to the department demonstrating that the applicable citizen advisory committee has been informed of the application and has been given the opportunity to carry out its advisory role.
