An Act To Clarify the Responsibilities of Pharmacy Benefits Managers and Preferred Provider Organizations
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 24-A MRSA §4317, sub-§4 is enacted to read:
4. Pharmacy benefits managers; preferred provider organizations. For the purposes of this section, a pharmacy benefits manager registered under section 1913, or a preferred provider arrangement administrator registered under section 2674-A that administers a preferred provider arrangement for pharmacy services, is subject to the same requirements as a carrier.

This bill provides that requirements governing the relationships between pharmacy providers and insurance carriers also apply to pharmacy benefits managers and preferred provider organizations that administer pharmacy services.
