An Act To Allow the Secretary of State to Issue a State Commercial Driver's License to the Holder of a Military Commercial Driver's License

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §1252, sub-§4,  as enacted by PL 1993, c. 683, Pt. A, §2 and affected by Pt. B, §5, is amended to read:

4. Examination.   The Secretary of State shall examine an applicant for the class for which the applicant applies except that the Secretary of State may issue a commercial driver's license without an examination to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces. The Secretary of State shall adopt rules, which are routine technical rules as defined in Title 5, chapter 375, subchapter 2A, governing the issuance of a commercial driver's license to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces.

Sec. 2. 29-A MRSA §1301, sub-§4,  as enacted by PL 1993, c. 683, Pt. A, §2 and affected by Pt. B, §5, is amended to read:

4. Examination.   An applicant must pass a physical examination by actual demonstration of ability to operate a motor vehicle and a written examination. Failure to complete the driving test within 18 months of receiving an instruction permit requires reexamination for the permit. The Secretary of State may issue a commercial driver's license without a physical or written examination to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces. The Secretary of State shall adopt rules, which are routine technical rules as defined in Title 5, chapter 375, subchapter 2A, governing the issuance of a commercial driver's license to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces.

SUMMARY

This bill authorizes the Secretary of State to issue a commercial driver's license without an examination to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces. It requires the Secretary of State to adopt rules governing the issuance of a commercial driver's license to an applicant who holds a valid commercial driver's license issued by the United States Armed Forces.
