‘Sec. 1. 38 MRSA §480-W, sub-§5 is enacted to read:
5. Barrier to protect a residence. Notwithstanding anything to the contrary in this article, the department may issue a permit to an owner of residential property in a coastal sand dune system to construct, repair or replace a year-round barrier landward of an existing seawall in a residential developed area after the owner has acquired all necessary state and local permits.’
