An Act To Strengthen the Informed Growth Act

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 30-A MRSA §4367, sub-§4, ¶C  is enacted to read:

C If the application is for a large-scale retail development with a gross floor area of over 150,000 square feet, the comprehensive economic impact study must contain the current average number of both part-time employees and full-time employees of the prospective tenant who are covered by the prospective tenant’s health insurance policy for the 2 existing retail operations of the prospective tenant located closest to the proposed development site in the State. If the prospective tenant does not have 2 existing retail operations in the State, then the comprehensive economic impact study must provide the information required in this paragraph from the 2 existing retail operations of the prospective tenant closest to the development site. If the prospective tenant does not have 2 existing retail operations, then the comprehensive impact study must provide the information required in this paragraph from one existing retail operation of the prospective tenant. If there are no existing retail operations of the prospective tenant, the study must project the number of part-time and full-time employees who will be covered by the insurance policy of the prospective tenant in the tenant’s prospective retail operation located on the development site. For purposes of this paragraph, "part-time employee" means an employee who customarily works less than 30 hours a week and "full-time employee" means an employee who customarily works 30 or more hours a week. A municipality exempt from the provisions of this chapter under section 4371 may require for a large-scale retail development of over 150,000 square feet of gross floor area the information required under this paragraph.

This bill requires the comprehensive economic impact study under the Informed Growth Act for a large-scale retail development having over 150,000 square feet of gross floor area to provide information concerning the average number of part-time and full-time employees of the prospective tenant who are covered by the prospective tenant’s health insurance policy.
