Amend the bill by striking out the title and substituting the following:

‘An Act To Authorize the Annexation of Redington Township in Franklin County to the Town of Carrabassett Valley’

Amend the bill by striking out all of the emergency preamble (page 1, lines 1 to 9 in L.D.)

Amend the bill by striking out all of section 1 (page 1, lines 11 to 17 in L.D.) and inserting the following:

Sec. 1. Redington Township, Township T1 R2, West of Bingham's Kennebec Purchase annexed to the Town of Carrabasset Valley. The unorganized territory consisting of Redington Township, Township T1 R2, West of Bingham's Kennebec Purchase in Franklin County is annexed to the Town of Carrabassett Valley.’

Amend the bill by inserting after section 2 the following:

Sec. 3. Tax assessment. The responsibility for property tax assessment for former Redington Township for tax year 2010 is the responsibility of the Town of Carrabasset Valley.’

Amend the bill by striking out all of sections 5 and 6 (page 1, lines 30 to 39 and page 2, lines 1 to 14 in L.D.) and inserting the following:

Sec. 5. Expedited permitting. The annexed land of Redington Township, Township T1 R2, must be included in the expedited permitting area defined in the Maine Revised Statutes, Title 35-A, section 3451, subsection 3.

Sec. 6. Referendum; effective date; certificate to Secretary of State. There are no legal voters in Redington Township, Township T1 R2. This Act must be submitted by October 1, 2010 to the legal voters in the Town of Carrabassett Valley at a town referendum for the purposes of voting on the annexation described in section 1 of this Act. The referendum must be held according to the provisions in the Maine Revised Statutes, Title 30-A, section 2528, including but not limited to appropriate notice, filing of the question with the clerk, absentee ballots and holding a public hearing. If the referendum fails, it may not be submitted again to the voters under the provisions of this Act.

The subject matter of this Act is reduced to the following question:

"Do you favor annexation by the Town of Carrabassett Valley of Redington Township, Township T1 R2, West of Bingham's Kennebec Purchase in Franklin County?"

The municipal officers of the town shall declare the result of the vote and the town clerk shall file due certificates of the vote with the Secretary of State within 10 days of the date of the vote. This Act takes effect for all purposes immediately upon its acceptance by a majority of the legal voters in the Town of Carrabassett Valley.’

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment, which is the majority report of the committee, authorizes the annexation by the Town of Carrabassett Valley of the whole of Redington Township, Township T1 R2, West of Bingham's Kennebec Purchase in Franklin County, rather than a portion of the township. It clarifies that the responsibility for property tax assessment will be the responsibility of the Town of Carrabasset Valley beginning in tax year 2010. It clarifies that a referendum to approve the annexation is required rather than a referendum at a town meeting. The referendum must take place before October 1, 2010. The amendment also strikes the emergency preamble and clause and changes the title.
