An Act To Require Semiannual Testing in Certain Gravel Pits

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 38 MRSA §490-G,  as amended by PL 1995, c. 700, §27, is further amended to read:

§ 490-G. Inspections

The regulator may periodically inspect a site, may examine relevant records of the owner or operator and may take samples and perform tests necessary to determine compliance with the provisions of this article. In addition, the regulator shall biannually perform tests at each site to determine the presence of toxic substances in the soil, air and waters surrounding the site. The regulator shall publish the results of the biannual tests on the department's publicly accessible website and shall submit the results to the municipality in which the site is located.
