An Act To Create a Speed Limit on Long Lake and Brandy Pond in Cumberland County

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §13068-B is enacted to read:

§ 13068-B. Speed Limits; Long Lake and Brandy Pond

1. Speed limit. A person may not operate a watercraft on Long Lake or Brandy Pond in Cumberland County in excess of 45 miles per hour between 1/2 hour before sunrise and 1/2 hour after sunset or in excess of 25 miles per hour at any other time. This subsection does not authorize a person to operate a watercraft in violation of any other provision of law.

2. Exception. The speed limits established in subsection 1 do not apply to:

A. Law enforcement personnel or emergency personnel during law enforcement operations or emergency operations to protect the safety and health of the public; and

B. Participants in activities permitted under section 13061.

3. Penalty. The following penalties apply to violations of subsection 1.

A. A person who violates subsection 1 commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B. A person who violates subsection 1 after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

Revenue from violations adjudged under this section must be used for enforcement operations by the Bureau of Warden Service.

4. Repeal. This section is repealed December 31, 2012.

Sec. 2. Report on watercraft speed limits. The Commissioner of Inland Fisheries and Wildlife shall report to the joint standing committee of the Legislature having jurisdiction over inland fisheries and wildlife matters on the effectiveness and feasibility of the watercraft speed limits on Long Lake and Brandy Pond in Cumberland County no later than February 15, 2012. The joint standing committee may submit legislation based on that report during the Second Regular Session of the 125th Legislature.

Sec. 3. Effective date. This Act takes effect January 1, 2010.

This bill establishes speed limits for the operation of watercraft on Long Lake and Brandy Pond in Cumberland County and provides that fine revenues from speeding violations must be used for enforcement operations by the Department of Inland Fisheries and Wildlife, Bureau of Warden Service. The speed limits are repealed December 31, 2012. This bill also requires the Commissioner of Inland Fisheries and Wildlife to report to the joint standing committee of the Legislature having jurisdiction over inland fisheries and wildlife matters on the effectiveness and feasibility of the speed limits by no later than February 15, 2012.
