An Act To Protect Groundwater and Surface Water from Contamination

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 38 MRSA §1303-C, sub-§19-D  is enacted to read:

19-D Offal.   "Offal" means organic waste generated at slaughterhouses and not intended for human consumption, such as blood, entrails, skin, feathers and bones.

Sec. 2. 38 MRSA §1304, sub-§20  is enacted to read:

20 Rules; composting of offal.   The board shall adopt rules relating to the composting of offal. The rules must include, but are not limited to, provisions to protect groundwater and surface water from contamination and to protect public health and safety. Rules adopted pursuant to this subsection are routine technical rules pursuant to Title 5, chapter 375, subchapter 2-A.

Sec. 3. 38 MRSA §1306, sub-§7  is enacted to read:

7 Composting of offal.   A site or facility composting offal may not accept volumes in excess of 30 cubic yards in any 30-day period without first obtaining a license in accordance with the provisions of this chapter.

This bill defines "offal." The bill also requires the Board of Environmental Protection to adopt rules relating to the composting of offal. The bill also limits the volume of offal that a hazardous waste site or facility may compost to 30 cubic yards in any 30-day period without the site's or facility's first obtaining a license.
