Amend the amendment by inserting after Part ZZZZ the following:

PART AAAAA

Sec. AAAAA-1. 5 MRSA §1825,  as amended by PL 1991, c. 780, Pt. Y, §69, is repealed and the following enacted in its place:

§ 1825 Prohibitions

1 Heavy equipment.   All state agencies, except the Department of Transportation, are prohibited from purchasing what is normally classified as heavy equipment not previously authorized by the Legislature through the budget process, without prior written authorization from the Commissioner of Administrative and Financial Services. All purchase requisitions for heavy equipment must indicate the budget year and account that authorized each item of equipment and, if required, contain the written authorization of the Commissioner of Administrative and Financial Services.
2 Bottled water.   All state agencies are prohibited from purchasing bottled water without prior written authorization from the Commissioner of Administrative and Financial Services.

Sec. AAAAA-2. Calculation and transfer; bottled water savings. Notwithstanding any provision of law, the State Budget Officer shall calculate the amount of savings in the Departments and Agencies - Statewide account in this Part that applies against each General Fund account for departments and agencies from bottled water savings. The State Budget Officer shall transfer savings by financial order upon approval of the Governor. These transfers are considered adjustments to appropriations in fiscal years 2009-10 and 2010-11.

Sec. AAAAA-3. Appropriations and allocations. The following appropriations and allocations are made.

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment prohibits all state agencies from purchasing bottled water. It includes a General Fund deappropriation of $35,000 in fiscal year 2009-10 and fiscal year 2010-11 from a statewide account and authorizes the State Budget Officer to distribute the savings by financial order to the individual programs as adjustments to appropriations.
