Amend the bill by inserting after section 1 the following:

Sec. 2. 20-A MRSA §1002, sub-§2-B  is enacted to read:

2-B Waiver of restriction on volunteers.   Notwithstanding subsection 2-A, the commissioner, upon application by the school board or superintendent of a small or geographically isolated school, may waive the restrictions of subsection 2-A when the number of school volunteers is significantly limited by the size of the community in which the school is located. The commissioner shall adopt routine technical rules, as defined in Title 5, chapter 375, subchapter 2-A, to implement the provisions of this subsection.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

Current law prohibits a member of a school board or that member’s spouse from serving as a volunteer in a public school over which the member’s school board has jurisdiction if the volunteer has primary responsibility for a curricular, cocurricular or extracurricular program or activity and reports directly to the superintendent, principal, athletic director or other school administrator.

This amendment allows the Commissioner of Education to waive this restriction upon application by the school board or superintendent of a small or geographically isolated school if the number of volunteers is limited by the size of the community in which the school is located.
