An Act Concerning Licensure as a Master Well Driller or a Master Pump Installer

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  this legislation needs to take effect before the expiration of the 90-day period in order to mitigate the hardship that would occur to certain businesses and persons if the exceptions to the laws concerning licensure as a master well driller or a master pump installer contained in this legislation did not take effect as soon as possible; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 32 MRSA §4700-I, sub-§5  is enacted to read:

5 Exceptions.   Notwithstanding this section, a person who provides evidence to the commission that that person has 5 years or more of well drilling experience of at least 1,000 hours in each of those 5 years under the supervision of a master well driller may sit for the master well driller examination under subsection 4 and may be licensed as a master well driller. A person who provides evidence to the commission that that person has 5 years or more of pump installation experience of at least 350 hours in each of those 5 years under the supervision of a master pump installer may sit for the master pump installer examination under subsection 4 and may be licensed as a master pump installer.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

This bill provides for an exception to the current licensure laws for a master well driller and a master pump installer.
