An Act To Permit Operation of a Modified Show Vehicle on a Public Way

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §101, sub-§35-A,  as enacted by PL 2001, c. 225, §1, is amended to read:

35-A. Modified show vehicle.   "Modified show vehicle" means a factory-produced 2-wheel-drive motor vehicle manufactured after 1949 that is equipped with modified components and that qualifies as a modified show vehicle under rules adopted by the Chief of the State Police.

Sec. 2. 29-A MRSA §102, sub-§3  is enacted to read:

3 Modified show vehicle.   A modified show vehicle may be operated on a public way for the purpose of participating in a modified show vehicle event, off-road competition or racing event. The Chief of the State Police shall adopt rules to allow the operation of a modified show vehicle on a public way. Rules adopted pursuant to this subsection are major substantive rules as defined in Title 5, chapter 375, subchapter 2-A.

Sec. 3. 29-A MRSA §1752, sub-§10,  as amended by PL 2003, c. 397, §7, is further amended to read:

10. Experimental motor vehicle.   A vehicle registered as an experimental motor vehicle pursuant to section 470. An experimental motor vehicle must meet minimum equipment standards pursuant to section 470, subsection 2; and

Sec. 4. 29-A MRSA §1752, sub-§11,  as enacted by PL 2003, c. 397, §8, is amended to read:

11. Low-speed vehicle.   A low-speed vehicle registered pursuant to section 501, subsection 11. A low-speed vehicle must be equipped in accordance with section 1925 . ; and

Sec. 5. 29-A MRSA §1752, sub-§12  is enacted to read:

12 Modified show vehicle.   A modified show vehicle that has a partial annual inspection consisting of the running gear, steering mechanism, brakes, exhaust system and lights; safety glass under section 1915; and tires under section 1917, subsection 3.

The bill directs the Chief of the State Police to adopt major substantive rules to allow the operation of a modified show vehicle on a public way for the purposes of participating in a modified show vehicle event, off-road competition or racing event. The bill also provides for a limited inspection of a modified show vehicle.
