An Act To Protect Owners and Occupiers of Homes from Civil Liability

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 14 MRSA §171  is enacted to read:

§ 171 Immunity for owners and occupiers of homes

An owner, lawful occupier or resident of a home, including a guest, is immune from civil liability for personal injury, death or property damage, including any monetary loss, that results from the performance of protecting the home or residents or guests in the home from a person unlawfully present in or attempting to enter the home without permission or consent from a person legally authorized to give consent to enter or be in the home.

This bill immunizes from civil liability an owner, occupier or resident of a home, including a guest, from any death, personal injury or property damage that results from protecting the home or its residents from a person unlawfully present in or attempting to enter the home.
