Amend the bill in section 1 in paragraph F by striking out all of the 4th sentence (page 1, lines 12 to 15 in L.D.) and inserting the following: ' If the list of 3 qualified candidates required by this paragraph to be presented to the Governor by the leaders of each party from each body of the Legislature is not produced within 60 days after the vacancy is created, then the leaders of each party from both bodies of the Legislature shall present within the subsequent 15 days a separate list of 3 qualified candidates to the Governor, who shall appoint a candidate from these lists within 30 days of receiving the lists.'

Amend the bill in section 2 in paragraph G by striking out all of the 4th sentence (page 1, lines 29 to 31 in L.D.) and inserting the following: ' If the list of 3 qualified candidates required by this paragraph to be presented to the Governor by the leaders of each party from each body of the Legislature is not produced within 60 days after the vacancy is created, then the leaders of each party from both bodies of the Legislature shall present within the subsequent 15 days a separate list of 3 qualified candidates to the Governor, who shall appoint a candidate from these lists within 30 days of receiving the lists.'

summary

This amendment replaces the proposal made by the bill that would have required the Governor to appoint a candidate to fill a vacancy for the 5th member of the Commission on Governmental Ethics and Election Practices if the leaders of each party from both bodies of the Legislature fail to provide a jointly derived list of 3 qualified candidates within 60 days of the vacancy's being created. The amendment provides that if the jointly derived list is not presented to the Governor within 60 days of the vacancy's being created, then within the subsequent 15 days each party from both bodies of the Legislature shall present a separate list to the Governor, who shall appoint a candidate within 30 days of receiving the lists.
