Amend the bill by striking out all of section 1 and inserting the following:

Sec. 1. 28-A MRSA §2513,  as enacted by PL 1987, c. 45, Pt. A, §4, is amended by adding at the end a new paragraph to read:

"Good cause," as used in this section, includes, but is not limited to, the plaintiff's inability to access within the 180-day period law enforcement investigative information concerning the time, place and circumstances of the server's conduct creating liability under this Act.

This amendment is a minority report of the Joint Standing Committee on Judiciary.

This amendment clarifies that the extension of the 180-day notice period for good cause shown includes, but is not limited to, the plaintiff's inability to access law enforcement investigative information concerning the time, place and circumstances relating to the conduct of the person who served liquor.
