Resolve, To Investigate Cellular Telephone Use and Driver Safety

Sec. 1. Department of Public Safety to study cellular telephone use and motor vehicle accidents. Resolved: That the Department of Public Safety shall study the role the use of cellular telephones have played in motor vehicle accidents. The Department of Public Safety shall solicit information from insurance companies regarding statistics and other information on cellular telephone use and motor vehicle safety and compile information received from law enforcement agencies pursuant to section 2 in performing the study required under this section; and be it further

Sec. 2. Law enforcement agencies to report information to Department of Public Safety. Resolved: That a law enforcement agency shall inform the Department of Public Safety of any motor vehicle incident, accident, violation or warning between October 1, 2007 and September 30, 2008 in which a cellular telephone was involved; and be it further

Sec. 3. Report. Resolved: That the Department of Public Safety shall submit its report along with any recommended legislation to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters by January 15, 2009. The joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters may submit legislation related to the report to the First Regular Session of the 124th Legislature.

SUMMARY

This resolve requires law enforcement agencies to inform the Department of Public Safety of motor vehicle incidents, accidents, violations and warnings from October 1, 2007 to September 30, 2008 in which cellular telephones were involved. This resolve requires the Department of Public Safety to study the role that cellular telephones may have played in contributing to motor vehicle accidents, using the information received from law enforcement agencies as well as from insurance companies, and to report its findings and recommended legislation to the joint standing committee of the Legislature having jurisdiction over criminal justice and public safety matters by January 15, 2009, with the committee having authority to submit legislation based upon the findings of the study.
