An Act To Protect Beef Producers

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §12404, sub-§9  is enacted to read:

9 Moose.   This subsection applies to the taking or killing of moose on property where cattle are kept, whether the property is owned or leased.
A Notwithstanding section 12401, an owner of cattle under this subsection is not required to catch moose in the act of damaging property or worrying cattle. The owner of cattle shall document, by reporting to a warden, 3 or more incidents of damage, after which the owner may kill moose found anywhere and at any time on property occupied by cattle.
B An owner of cattle may employ an agent to kill moose pursuant to paragraph A after receiving written permission from a warden. The warden may either issue a certificate or, at the request of the person who killed the moose, remove the moose from the property.

This bill allows a person to take or kill moose that are damaging property where cattle are kept or worrying the cattle on that property.
