An Act To Protect Children from Lead Exposure by Requiring Sufficient Notice of Renovations

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 38 MRSA §1298  is enacted to read:

§ 1298 Child-occupied structure

A person who engages in an activity involving lead-based paint, or engages in an activity that has a risk of creating a lead hazard, in a residential structure in which a child lives must give notice of the activity by posting a sign on the structure and by certified mail to every household in the structure at least 30 days before the activity is performed. Notice under this section may be given at least 7 days before the activity is performed if each adult who lives in the structure signs an acknowledgment and waiver form for that particular activity.

This bill requires a person to give to every household in a residential structure 30 days' notice by posting and by certified mail of an activity involving lead-based paint or that has a risk of creating a lead hazard if the structure is child-occupied. The notice may be a 7 days' notice if each adult who lives in the structure signs an acknowledgment and waiver form.
