Amend the bill by striking out everything after the title and before the summary and inserting the following:

‘Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  the Highway Fund allocation to the Department of Transportation to study the feasibility of locating a new bridge in the St. David area is to take place in fiscal year 2007-08; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. Appropriations and allocations. The following appropriations and allocations are made.

TRANSPORTATION, DEPARTMENT OF

Highway and Bridge Improvement 0406

Initiative: Allocates funds on a one-time basis to study the feasibility of locating a new bridge in the St. David area. Any unspent funds not needed for the costs of the study are to be used for the costs of an environmental impact study required by the federal National Environmental Policy Act of 1969.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.’

Summary

This amendment eliminates the appropriation of funds from the Highway Fund to the Madawaska Bridge Committee that was included in the bill to defray expenses incurred by the committee in its effort to locate a new bridge in the St. David area.

The amendment adds an emergency preamble and emergency clause to the bill as $200,000 from the Highway Fund will be allocated in fiscal year 2007-08.
