Correctional and Judicial Impact Statements
Increases the Class of Crime for Home Trespass from Class D to Class C.
The collection of additional fines may increase General Fund revenue by minor amounts.
Fiscal Detail and Notes
Increasing the class of crime for home trespass from a Class D to a Class C crime with a minimum unsuspendable sentence of three years for a first offense, 5 years for a second offense within 10 years and a Class B crime with a minimum unsuspendable sentence of 10 years for a third or more conviction within 10 years will increase the number and length of preliminary motions, trials, post-conviction proceedings and appeals.  This bill will require a General Fund appropriation to the Judicial Department in the amount of $394,192 in fiscal year 2005-06 and $372,867 in fiscal year 2006-07.  This appropriation will provide funds for a judge position, an assistant clerk position, a security officer position, a part-time law clerk, a part-time secretary and additional court-appointed attorney hours required to handle the expected increase in workload.
