An Act To Prevent the Introduction of Pathogens into the

 
State That Threaten the Health of Maine's Fish and Wildlife

 
Resources

 
Emergency preamble. Whereas, acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

 
Whereas, chronic wasting disease is a fatal, highly infectious
disease that has devastated deer and moose populations in other
states; and

 
Whereas, chronic wasting disease is an immediate threat to
Maine's deer and moose population; and

 
Whereas, immediate action is necessary to prevent the spread of
this disease into Maine's deer and moose population; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

 
Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 12 MRSA §10105, sub-§13 is enacted to read:

 
13.__Prevention of introduction of harmful pathogens into
Maine's fish and wildlife population.__To prevent the
introduction of pathogens into the State that pose a significant
risk to the health of Maine's unique fish and wildlife
populations, the commissioner may prohibit or otherwise regulate
the transportation of a fish or wildlife species or any part of a
