Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §3194 is enacted to read:

 
§3194.__Health care disclosure

 
1.__Proposed beneficiary defined.__As used in this section,
unless the context otherwise indicates, "proposed beneficiary"
means:

 
A.__An individual who files an application for health care
benefits under MaineCare; or

 
B.__A person requesting uncompensated care in a hospital.

 
2.__Information required.__A proposed beneficiary, upon
applying for health care benefits under MaineCare or upon
requesting uncompensated care in a hospital, shall identify the
employer or employers of the proposed beneficiary.__If the
proposed beneficiary is not employed, the proposed beneficiary
shall identify the employer or employers of any adult who is
responsible for providing all or some of the proposed
beneficiary's support.

 
3.__Provision of information to the Legislature.__On or before
October 1st annually, the department shall transmit to the
Legislature a report identifying all employers identified
pursuant to the application requirements in subsection 2 who
employ 50 or more MaineCare beneficiaries.__In determining
whether the 50-employee threshold is met, the department shall
include all MaineCare beneficiaries employed by the employer and
its subsidiaries at all locations within the State.__The report
must include each employer's name, location or locations, the
total number of its employees and dependents who are enrolled in
the MaineCare program and the total cost to the State of
providing MaineCare benefits for the employees and enrolled
dependents of each named employer.__The report may not include
the names of any individual beneficiaries of the MaineCare
program.

 
4.__Public access to information.__The department shall post
the report produced pursuant to subsection 3 on a publicly
accessible site on the Internet maintained by the department and
shall make copies of the report available to members of the
public upon request.
