Item 1

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 28-A MRSA §708, sub-§5, as enacted by PL 1993, c. 615, §4, is
amended to read:

5. Combination packages. Notwithstanding subsection 3,
agency liquor store licensees may offer for sale any package or
combination of packages of spirits or use marketing promotions
for spirits that the commission has approved for sale in state
liquor stores use in the State, as long as the package,
combination of packages or promotion conforms with the standards
set forth in regulations under the Federal Alcohol Administration
Act.

SUMMARY

This bill clarifies the law regarding promotions in agency
liquor stores to allow licensees to offer for sale any package or
combination of packages of spirits or use marketing promotions
for spirits that the State Liquor and Lottery Commission has
approved for use in the State as long as they conform to the
standards of the Federal Alcohol Administration Act. Confusion
over this issue has resulted from the current reference in law to
items approved for sale in "state liquor stores" since those no
longer exist.
