	Sec. 1. Increased MaineCare reimbursement rates for physicians with high ratios of
MaineCare patients. Resolved: That the Department of Health and Human
Services shall adopt rules to develop a schedule that provides a
greater rate of MaineCare reimbursement for private practice
physicians who have a high proportion of MaineCare patients. The
schedule must be graduated, providing for a rate of MaineCare
reimbursement that increases based on the percentage of patients
in the physician's practice who are MaineCare recipients. The
schedule also must provide an additional increase in the rate of
reimbursement for those physicians located in rural areas of the
State with a high of percentage patients who are MaineCare
recipients. Rules adopted pursuant to this resolve are major
substantive rules as defined in the Maine Revised Statutes, Title
5, chapter 375, subchapter 2-A. The department shall adopt
provisional rules by November 1, 2005 and shall submit the rules
for review to the Second Regular Session of the 122nd Legislature
no later than December 1, 2005.

SUMMARY

This resolve requires the Department of Health and Human
Services to adopt major substantive rules that establish a
MaineCare reimbursement schedule that provides a greater rate of
MaineCare reimbursement to physicians in private practice who
have a high ratio of patients who are MaineCare recipients. The
schedule must also provide for a higher rate of MaineCare
reimbursement if the physician is located in a rural area of the
State.
