Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §1471-Y is enacted to read:

 
§1471-Y.__Report of pesticide use

 
1.__Report required.__Any commercial applicator, private
applicator or spray contracting firm certified by the board shall
report in writing to the board for each pesticide application
that will be performed by that person:

 
A.__The type of pesticide that will be applied;

 
B.__The amount of pesticide that will be applied; and

 
C.__The time and place the pesticide will be applied.

 
2.__Definitions.__As used in this section, unless the context
otherwise indicates, "pesticide" means any chemical used to kill
or inhibit the growth of a target organism and includes, but is
not limited to, pesticides, herbicides, fungicides and
insecticides.

 
3.__Public availability.__The board shall make the information
reported under subsection 1 easily available to members of the
public.

 
4.__Rules.__The board shall adopt routine technical rules
pursuant to Title 5, chapter 375, subchapter 2-A to implement
this section.__The rules must include what constitutes a
pesticide application and the level of detail required to be
reported under subsection 1.

 
SUMMARY

 
This bill requires persons certified to apply pesticides to
provide written notice of pesticide application to the Board of
Pesticides Control concerning the type and amount of pesticide
and the time and place of application. The board must then make
that information easily available to the public.
