2.__Liability.__A podiatrist who delegates activities as
described in subsection 1 to a podiatric assistant is legally
liable for the medical activities of that podiatric assistant,
and a podiatric assistant in this relationship is considered the
podiatrist's agent.__This subsection may not be construed to
apply to an individual acting under a separate license accepted
by the State to render services independently.

 
Emergency clause. In view of the emergency cited in the preamble,
this Act takes effect when approved.

 
SUMMARY

 
This bill amends the laws governing podiatric practice by
clarifying that podiatrists are authorized to use podiatric
assistants in all aspects of podiatric medicine if each podiatric
assistant is in training or has completed training and a
competency evaluation approved by the Board of Licensure of
Podiatric Medicine. A podiatrist is legally liable for the
medical activities performed by that podiatrist's podiatric
assistant.
