Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 12 MRSA §10001, sub-§12-A, as enacted by PL 2003, c. 552, §1
and affected by §15 and c. 655, Pt. C, §§2 and 6, is amended to
read:

 
12-A. Dip net. "Dipnet" "Dip net" means a device consisting
of a rigid frame with a maximum hoop size of 24 inches, filled
with netting, firmly attached to a rigid handle and manually
operated by a single person.

 
Sec. 2. 12 MRSA §12456, sub-§2, ¶A, as enacted by PL 2003, c. 414, Pt.
A, §2 and affected by c. 614, §9, is amended to read;

 
A. A From March 15th to November 30th, a person may take
smelts at any time from noon to midnight in accordance with
bag limits established by rule by the use of a dipnet dip
net in the usual and ordinary way in inland waters or
portions of inland waters that are naturally free of ice,
and where the taking of smelts is not prohibited by rules of
the commissioner.__Only 5 dozen smelts per person may be
kept alive as part of the daily bag limit;

 
Sec. 3. 12 MRSA §12551-A, sub-§7, ¶¶A and B, as enacted by PL 2003, c.
655, Pt. B, §259 and affected by §422, are amended to read:

 
A. The holder of a smelt wholesale dealer's license may:

 
(1) Take live smelts for resale from any inland water
or private pond. The taking of live smelts from inland
waters must be in accordance with general rules adopted
by the commissioner in regard to the taking of smelts.
Except as provided in paragraph B, the holder of a
smelt wholesaler's license shall comply with the same
daily bag limit and the same tackle restrictions that
apply to all other anglers and is subject to the same
penalties for violations of those limits and
restrictions;

 
(2) Use From December 1st to March 14th, use a baitfish trap, a
dip net, a drop net, a lift net, a bag net or hook and line to
take up to 8 quarts of smelts in a 24-hour period, beginning at
noon on a given day, from specific inland waters designated by
the commissioner.__From March 15th to November 30th, a person
licensed under this section may take smelts in accordance with
the bag limit established by rule of the commissioner from noon
to midnight by the use of a
