Sec. 1. Suit against Federal Government. Resolved: That, if the State
receives insufficient funds from the Federal Government to
implement the federal No Child Left Behind Act of 2001, the
Attorney General shall bring an action on behalf of the State and
the school administrative units within the State against the
Federal Government and appropriate parties for either an increase
in funding to the level necessary to fully implement the Act in
this State or relief from the requirements of the Act for which
costs are not covered by the federal funding received.

 
SUMMARY

 
This resolve directs the Attorney General to bring suit
against the Federal Government and any other appropriate parties
if the federal funding provided to the State is insufficient to
implement the No Child Left Behind Act of 2001. The Attorney
General may seek the necessary funding or may seek relief from
the imposition of the federal requirements for which funding is
insufficient.
