Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §2150-C, sub-§1, as enacted by PL 2001, c. 364, §1, is
amended to read:

 
1. Definitions. As used in this section chapter, unless the
context otherwise indicates, the following terms have the
following meanings.

 
A. "Automated external defibrillator" or "AED" means a
medical device approved by the United States Food and Drug
Administration that:

 
(1) Is capable of recognizing the presence or absence
of ventricular fibrillation or rapid ventricular
tachycardia;

 
(2) Is capable of determining whether defibrillation
should be performed on an individual;

 
(3) Upon determination that defibrillation should be
performed, automatically charges and requests delivery
of an electrical impulse to an individual's heart; and

 
(4) Upon action by an operator, delivers an
appropriate electrical impulse to the individual's
heart to perform defibrillation.

 
B. "Department" means the Department of Public Safety.

 
Sec. 2. 22 MRSA §2150-D is enacted to read:

 
§2150-D. Facilities for adults

 
1.__Equipment. A nursing home licensed under section 1811 or a
facility licensed for the care of adults under Subtitle 6,
including a long-term care facility, residential care facility,
assisted housing program or assisted living program, must be
equipped with an automated external defibrillator on each floor
of the facility.

 
2.__Training. A staff member for a nursing home licensed under
section 1811 or a facility licensed for the care of adults under
Subtitle 6, including a long-term care facility, residential care
facility, assisted housing program or assisted living program,
must be certified to perform cardiopulmonary resuscitation and
trained to operate an automated external defibrillator.
