An Act To Implement Regulatory Reforms and To Address

 
Staffing Issues in Long-term Care Facilities

 
Emergency preamble. Whereas, Acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

 
Whereas, long-term care facilities and programs operate within a
highly regulated system that inflates the cost of care for
elderly and disabled persons; and

 
Whereas, implementation of regulatory reform and staffing
changes in long-term care facilities will provide regulatory
relief beginning immediately upon implementation; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

 
Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §334, as enacted by PL 2001, c. 664, §2, is amended
to read:

 
§334. Nursing facility projects

 
Nursing facility projects that propose to add new nursing
facility beds to the inventory of nursing facility beds within
