| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 20-A MRSA §4009-A is enacted to read: |

| | | §4009-A.__Pornography restrictions |
|
| | | An elementary or secondary school in the State may not allow a | | person under 18 years of age to access obscene, pornographic or | | other material that may be harmful to a person under 18 years of | | age through the use of a computer or computer server of the | | school. |

| | | Sec. 2. 27 MRSA §39, sub-§3 is enacted to read: |

| | | 3.__Pornography restrictions.__A school, state, institutional | | or public library in the State may not allow a person under 18 | | years of age to access obscene, pornographic or other material | | that may be harmful to a person under 18 years of age through the | | use of a computer or computer server of the school, state, | | institutional or public library. |

| | | Sec. 3. Rules. The Department of Education and the Maine State | | Library shall adopt rules to carry out the purposes of this Act. | | The Department of Education and the Maine State Library shall | | collaborate in adopting these rules in an effort to provide | | uniformity to the rules. Rules adopted pursuant to this Act are | | major substantive rules as defined in the Maine Revised Statutes, | | Title 5, chapter 375, subchapter II-A. |
