Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 32 MRSA §13796 is enacted to read:

 
§13796.__Psychotropic drugs

 
Prior to a practitioner prescribing a psychotropic drug to a
person under 18 years of age, the practitioner must have the
person's parent or guardian read the full information on the
psychotropic drug in a nationally recognized physician's desk
reference family guide to prescription drugs and obtain written
attestation from the parent or guardian that the information,
including the drug's side effects, is understood.__If the parent
or legal guardian does not understand the written psychotropic
drug information, the practitioner shall fully explain the
information, including the drug's side effects, to the parent or
guardian before obtaining the written attestation.__The
attestation must be kept on file as part of the person's medical
record.

 
SUMMARY

 
This bill requires a practitioner, prior to prescribing a
psychotropic drug to a person under 18 years of age, to ensure
that the person's parent or guardian fully understands the
information concerning the drug, including the drug's side
effects.
