Emergency preamble. Whereas, Acts and resolves of the Legislature do
not become effective until 90 days after adjournment unless
enacted as emergencies; and

 
Whereas, the Commission to Study Privacy Laws must be initiated
before the 90-day period expires to allow the commission to
initiate a comprehensive study of privacy laws and to submit a
report to the next legislative session; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore, be it

 
Sec. 1. Commission established. Resolved: That the Commission to Study
Privacy Laws, referred to in this resolve as the "commission," is
established; and be it further

 
Sec. 2. Commission membership. Resolved: That the commission consists
of the following 10 members:

 
1. Five members of the Legislature, appointed jointly by the
presiding President of the Senate and the Speaker of the House.
When making the appointments the presiding President of the
Senate and the Speaker of the House shall give preference to
members of the Joint Standing Committee on Judiciary, the Joint
Standing Committee on Criminal Justice, the Joint Standing
Committee on Health and Human Services, the Joint Standing
Committee on Banking and Insurance and the Joint Standing
Committee on Education and Cultural Affairs;

 
2. The Director of the Maine Civil Liberties Union or the
director's designee;

 
3. One member representing the banking and insurance
industry, appointed by the Governor;

 
4. One member representing health care, appointed by the
Governor;

 
5. One member representing criminal defense attorneys,
appointed by the Maine Association of Criminal Defense Lawyers;
and

 
6. One member representing state employees, appointed by the
Maine State Employees Association; and be it further
