Sec. 1. Rulemaking for on-line sales of licenses, permits and registrations. Resolved:
That the Commissioner of Inland Fisheries and Wildlife shall
adopt rules establishing the criteria for requiring agents to
develop interactive computer capacity in order to sell licenses
or permits or watercraft, snowmobile or all-terrain vehicle
registrations. These rules must establish the process for
testing the interactive program, a 5-year timetable for requiring
agents to develop interactive capacity, procedures for ensuring
that the license documentation can not easily be reproduced and a
process for the electronic transfer of funds from the agents to
the State. Rules adopted under this subsection are major
substantive rules pursuant to the Maine Revised Statutes, Title
3, chapter 375, subchapter II-A.

 
SUMMARY

 
This resolve requires the Commissioner of Inland Fisheries and
Wildlife to adopt major substantive rules establishing criteria
to govern the requirement that agents of the Department of Inland
Fisheries and Wildlife must develop computer interactive capacity
in order to sell hunting and fishing licenses and register
watercraft, snowmobiles and all-terrain vehicles. At minimum the
commissioner is required to develop rules that:

 
1. Create a pilot program to test the on-line program;

 
2. Establish a 5-year timetable for requiring agents to sell
on-line licenses and registrations;

 
3. Ensure that license and registration documentation will
not easily be reproduced; and

 
4. Create an electronic transfer of funds system that is
agreed to by the department and agents.
