Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 12 MRSA §6001, sub-§41, as enacted by PL 1977, c. 661, §5, is
amended to read:

 
41. Shellfish. "Shellfish" means clams, quahogs, oysters and
mussels and includes shellstock and shucked shellfish. all
species of:

 
A.__Clams, quahogs, oysters and mussels, whether:

 
(1)__Shucked or in the shell;

 
(2)__Fresh or frozen; or

 
(3)__Whole or in part; and

 
B.__Scallops in any form, except when the final product form
is the adductor muscle of a mussel only.

 
SUMMARY

 
This bill amends the definition of shellfish to include
scallop in any form other than the adductor muscle of a mussel.
This allows the emerging market for whole scallops to occur under
shellfish sanitation regulations that protect the public health
from shellfish contaminated by pollution or marine toxins.
