Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 22 MRSA §254, sub-§10, as enacted by PL 1999, c. 401, Pt. KKK,
§1 and affected by §10 and c. 531, Pt. F, §2, is amended to read:

 
10. Eligible individuals. To In addition to the other
requirements of this section and Title 36, section 6162-B, to be
eligible for the program, an individual must be:

 
A. At least 62 years of age; or

 
B. Nineteen years of age or older and determined to be
disabled by the standards of the federal social security
program.; or

 
C.__A member of a household in which another household
member is eligible for the program.

 
SUMMARY

 
Prior to changes to the elderly low-cost drug program enacted
in Public Law 1999, chapter 401, Part KKK, eligibility for the
program extended to all members of a household if any household
member was determined to be eligible. The changes enacted in
Public Law 1999, chapter 401, Part KKK, inadvertently caused some
household members to lose eligibility. This amendment restores
household eligibility as it applied before the 1999 changes.
