that may be due from any other source except that a benefit is not
payable under this section with respect to the death of an officer
if a benefit is paid pursuant to Title 5 with respect to the
disability of that officer.

 
6.__Execution or attachment prohibited.__A benefit paid under
this section is not subject to execution or attachment.

 
7.__Rulemaking.__The Chief of the State Police shall propose
rules to carry out the purposes of this section.__Rules adopted
pursuant to this section are major substantive rules pursuant to
Title 5, chapter 375, subchapter II-A.

 
SUMMARY

 
This bill, based on federal law, establishes a death benefit
of $50,000 for state police officers killed in the line of duty.
The bill designates to whom the benefit is paid and in what
proportion and allows for an interim payment to the surviving
spouse, child or parent of the slain state police officer. If
the state police officer received or the officer's estate
received a disability payment from the Maine State Retirement
System, the death benefit is not payable.
