Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 28-A MRSA §2, sub-§30-A is enacted to read:

 
30-A.__Specialty wine store.__"Specialty wine store" means a
store that at least 1/3 of its sales is derived from the sale of
wine.

 
Sec. 2. 28-A MRSA §1205, sub-§2, ¶¶C, H, J and K, as enacted by PL 1989, c.
488, are amended to read:

 
C. No A person may be charged a fee for any wine served as
part of a taste-testing activity;

 
H. A retail licensee may conduct no more than one unlimited
taste testing testings per month;

 
J. The retail licensee must notify the Bureau of Liquor
Enforcement of the date and time scheduled for an on-premise
taste testing; and

 
K. The retail licensee must purchase all wine served at a
taste testing from a wholesale licensee.; and

 
Sec. 3. 28-A MRSA §1205, sub-§2, ¶L is enacted to read:

 
L.__The retail licensee may sell the wine that is being
tasted at the taste testing.

 
Sec. 4. 28-A MRSA §1402-B is enacted to read:

 
§1402-B.__Specialty wine store; samples

 
1.__Wine sampling.__An owner of a specialty wine store may
designate an area or a room for the specific purpose of sampling
wine.

 
2.__Conditions of wine sampling.__The following conditions
apply to all wine sampling.

 
A.__An employee may provide the products for wine sampling
only if all taxes and premiums required by this Title are
paid.

 
B.__Wine sampling must be conducted only within the
designated area or room.
