Sec. 1. 28-A MRSA §1402-A, sub-§§5 and 6, as enacted by PL 1997, c. 228, §1, are amended to read:

5. Samples removed. Beer and wine samples given to an off- premise retailer must be removed from the premises to be sampled; and

6. Records maintained. Records must be maintained for a 2- year period by the licensee giving or receiving samples.; and

Sec. 2. 28-A MRSA §1402-A, sub-§7 is enacted to read:

7.__Exception.__A retail licensee 50% or more of whose gross income is derived from the sale of wine, malt liquor or spirits is exempt from the limit on wine samples established in subsection 4.

SUMMARY

This bill removes the limit on the amount of wine samples that certain retailers licensed to sell wine may receive from a small brewery, farm winery or wholesaler.
