Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 38 MRSA §480-C, sub-§2, as enacted by PL 1987, c. 809. §2, is
amended to read:

 
2. Activities requiring a permit. The following activities
require a permit:

 
A. Dredging, bulldozing, removing or displacing soil, sand,
vegetation or other materials;

 
B. Draining or otherwise dewatering;

 
C. Filling, including adding sand or other material to a
sand dune; or

 
D. Any construction, repair or alteration of any permanent
structure.; or

 
E.__Reconstruction, replacement, alteration or expansion of
a structure located within a coastal sand dune system if:

 
(1)__The activity does not occur in a V-Zone designated
before January 1, 1999 by the Federal Emergency
Management Agency for the National Flood Insurance
Program; and

 
(2)__The activity occurs in a V-Zone designated after
January 1, 1999 by the Federal Emergency Management
Agency for the National Flood Insurance Program.

 
The department may not deny a permit for any activity under
this paragraph solely because the activity occurs in a V-
Zone designated after January 1, 1999 by the Federal
Emergency Management Agency for the National Flood Insurance
Program.

 
SUMMARY

 
This bill requires any building located within the so-called
V-Zone, as designated by the National Flood Insurance Program
after January 1, 1999, to have the same restrictions and permit
requirements that existed prior to expansion of the V-Zones.
