Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. Separation and incorporation. Subject to referendum elections as
set forth in section 3 of this Act and as otherwise specified in
this Act, the territory in section 2, the east side of
Machiasport, now within the Town of Machiasport, Washington
County, together with the inhabitants of that territory, is
separated and set off from the Town of Machiasport and
incorporated into the Town of East Machias, Washington County.

 
Sec. 2. Boundaries. The boundaries of the territory affected by
this Act are as follows.

 
All of the land, including buildings, intertidal land,
submerged land, fresh or salt water ponds, roads and land owned
by the Town of Machiasport, generally referred to as the east
side of Machiasport, containing 3,160 acres, more or less, and
bounded as follows: on the north by East Machias, on the south
by Machias Bay and on the east by Whiting.

 
Sec. 3. Referendum elections. In order for the separation and
incorporation described in this Act to take effect, the east side
of Machiasport must vote in an election to secede from the Town
of Machiasport and join the Town of East Machias and further, the
Town of East Machias must vote in an election to accept the
territory after that territory has voted in the affirmative for
secession and incorporation. A simple majority of the voters in
each referendum is necessary to approve the referendum.

 
1. East side of Machiasport; secession vote. Within 3 months
of the effective date of this Act, this Act must be submitted to
the legal voters of the east side of Machiasport in a referendum
election for the purpose of approval of this Act. Warrants must
be issued for this election notifying the qualified voters to
vote on the approval or rejection of this Act.

 
For purposes of this referendum election, all persons resident
of the east side of Machiasport and legally registered to vote
within the east side of Machiasport as set out in section 2 of
this Act are eligible to vote on the question with respect to the
separation of the east side of Machiasport from the Town of
Machiasport and its annexation to the Town of East Machias.

 
The Town Clerk of the Town of Machiasport shall prepare the
required ballots on which the subject matter of this Act must be
reduced to the following question:

 
"Do you favor the separation of the east side of Machiasport
from the Town of Machiasport and the annexation of the east
side of Machiasport to the Town of East Machias?"
