Sec. 1. 5 MRSA §17906, sub-§2, ¶F is enacted to read:

F.__An employer or organization with a self-funded health plan or an employee welfare benefit plan may recover any provisional payments made by filing a notice of offset with the Maine State Retirement System.

Sec. 2. 5 MRSA §17930, sub-§4, ¶F is enacted to read:

F.__An employer or organization with a self-funded health plan or an employee welfare benefit plan may recover any provisional payments made by filing a notice of offset with the Maine State Retirement System.

Sec. 3. 5 MRSA §18506, sub-§2, ¶F is enacted to read:

F.__An employer or organization with a self-funded health plan or an employee welfare benefit plan may recover any provisional payments made by filing a notice of offset with the Maine State Retirement System.

Sec. 4. 5 MRSA §18530, sub-§4, ¶F is enacted to read:

F.__An employer or organization with a self-funded health plan or an employee welfare benefit plan may recover any provisional payments made by filing a notice of offset with the Maine State Retirement System.

Sec. 5. 5 MRSA §18542, sub-§4 is enacted to read:

4.__Provisional payments.__An employer or organization with a self-funded health plan or an employee welfare benefit plan may recover any provisional payments made by filing a notice of offset with the Maine State Retirement System.

SUMMARY

This bill allows an employer or organization making provisional payments through a self-funded health plan or employee welfare benefit plan to recover those payments from the disability retirement benefit due the member.
