Sec. 1. Conservation easement held by the State on property leased by Robert Vadas
modified allowing placement of outhouse away from Penobscot River. Resolved: That
the conservation easement held by the State on property leased by
Robert Vadas must be modified to allow the placement of an
outhouse owned by Robert Vadas away from the Penobscot River.
The conservation easement held by the State and administered by
the Department of Conservation attaches to land leased by Robert
Vadas and owned by Bowater Incorporated. The conservation
easement must be modified to allow the outhouse of Mr. Vadas to
remain in the new location where Mr. Vadas placed the outhouse
away from the Penobscot River. The property on which the
conservation easement attaches is Great Northern Lease Number 619
located in Township 2, range 10 W.E.L.S., abutting the West
Branch of the Penobscot River.

 
SUMMARY

 
Robert Vadas owns a camp in Piscataquis County on land that
abuts the West Branch of the Penobscot River, leased from Bowater
Incorporated, which has a conservation easement held by the State
through the Department of Conservation. Mr. Vadas had an
outhouse on the property that was 15 feet from the river that he
moved away from the river and for which he received all necessary
permits. After moving the outhouse, Mr. Vadas was informed by
the Department of Conservation that the location of the outhouse
was in violation of the terms of the conservation easement. This
resolve modifies the conservation easement to allow the outhouse
to remain in its present location.
