Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 29-A MRSA §§2085 and 2086 are enacted to read:

 
§2085.__Passengers restricted to passenger compartment of pickup

 
truck

 
1.__Passengers under 19 years of age.__When a passenger under
19 years of age is transported in a pickup truck, that passenger
must ride in the passenger compartment of the pickup truck.

 
2.__Exceptions.__Subsection 1 does not apply to the following:

 
A.__Passengers in a truck camper;

 
B.__Passengers in a pickup truck being used for agricultural
purposes;

 
C.__Workers or trainees engaged in the necessary discharge
of their duties or training or being transported between
work or training locations;

 
D.__Participants in parades; or

 
E.__A passenger secured by a seat belt in a manufacturer-
installed seat located outside the passenger compartment.

 
§2086.__Transporting dogs in pickup trucks regulated

 
Transporting dogs in pickup trucks is governed by this
section.

 
1.__Restrictions.__A person driving a pickup truck may not
transport a dog in the back of the vehicle on a public way
unless:

 
A.__The space is enclosed or has side and tail racks to a
height of at least 46 inches extending vertically from the
floor;

 
B.__The dog is cross-tethered to the vehicle;

 
C.__The dog is protected by a secured container or cage; or

 
D.__The dog is otherwise protected in a manner that prevents
the dog from falling or jumping or being thrown from the
vehicle.
